By booking accommodation at Carib Mall Bonaire, you are agreeing to the following terms and conditions. Please read and understand these terms before submitting your online booking request. These terms and conditions are designed to protect both the guests (“Guests”) and Carib Mall Bonaire (“Carib Mall Bonaire” or “We”). Your stay at one of the accommodations of Carib Mall Bonaire will be governed by these terms and conditions, and it is your responsibility to familiarize yourself with them.

Definitions
a. Booking: The act of reserving or booking accommodations, cars, diving and/or any other services and supplies, which can be done online, by email, or through a third party.
b. Contract: The agreement for the booking and these general terms and conditions (including any other applicable terms and conditions mentioned for the booking).
c. Customer: Refers to an individual, legal entity, or partnership that has entered into an agreement with the accommodation. This term applies to various roles such as a guest, purchaser, tenant, lodger, occupant, tour operator, etc., encompassing anyone who has entered into a contract with the accommodation.
d. Guest: Whenever these general terms and conditions mention guests or customers, it includes both guests and customers unless the context clearly indicates otherwise.
e. Accommodation: All accommodations featured on this website, located in Bonaire CN, and the premises for which the booking is made. Other accommodations, not mentioned on this website, might be offered to you within a partnership between Carib Mall and other rental companies.
Reservations and Booking Conditions
Carib Mall Bonaire only accepts reservations from persons aged 18 years or older. Reservations made by minors are not valid. A reservation becomes valid only upon receipt of the required deposit and written confirmation. The Guest is responsible for verifying all reservation details upon receipt and must report any inaccuracies within 7 days. Failure to report inaccuracies within this period shall be deemed acceptance of the reservation details. Subletting or transfer without prior written approval is not permitted. Changes to reservations are subject to approval and may incur additional fees.
Payment Policy
Once your reservation is completed, you will receive a confirmation email along with the payment details. To confirm your reservation, a non-refundable deposit of 20% of the total stay amount is required. All payments must be made in USD and can be completed via bank transfer or credit card payment.
The remaining balance of 80% is due no later than 30 days before your arrival and is non-refundable. Once the payment has been received, a confirmation will be sent to you. Please note that reservations are not confirmed until full payment is received. Carib Mall Bonaire receives the right to cancel any booking that has not been fully paid within 29 days. prior to scheduled arrival. If the accommodation is booked within 30 days before arrival date, the total price will be charged at the time of booking.
All prices on our website are in U.S. dollars (USD).
All bank, card, and transaction fees are the responsibility of the Guest.
Cancellation Policy
All cancellation requests must be acknowledged in writing in order to be considered valid. If you need to cancel your reservation, the following cancellation policy applies:
Cancellations made 30 days or more before arrival will lose the deposit.
Cancellations made within 28 days of arrival are non-refundable, and the full reservation amount remains due.
Failure to arrive or no-show is treated as a cancellation within 30 days and is therefore non-refundable.
Date changes are possible if availability permits. Depending on the timing of the request for new dates, a fee may be charged in accordance with the cancellation policy.
We strongly recommend that Guests obtain travel and cancellation insurance to cover unforeseen circumstances that may affect their stay, as Carib Mall Bonaire is not responsible for costs resulting from cancellation, regardless of cause.
Cancellation or Modification by Carib Mall Bonaire
Carib Mall Bonaire may cancel or modify a reservation in the event of force majeure or circumstances beyond its reasonable control, including, but not limited to, natural disasters, extreme weather conditions, fire, government measures, war, strikes, or operational necessity. Where possible, alternative accommodations or a voucher for the value of the missed nights may be offered. Carib Mall Bonaire is not liable for any additional costs or damages resulting from cancellation or modification. Carib Mall Bonaire may also immediately terminate a stay in the event of serious disturbances, violation of the house rules, or improper use of the accommodation by the guest or a member of their party.
General Terms & Conditions
1.1 Use of Property at Own Risk
By making a reservation, the Guest acknowledges and agrees that the use of the property and all indoor and outdoor facilities, including but not limited to the garden, swimming pool, pool deck, and any access to the sea (if applicable), is entirely at the Guest’s own risk. The Guest accepts full responsibility for any risk of injury, accident, or illness, involving themselves, their family, or any guests during their stay and/or use of the property. To the extent permitted by applicable law, the Guest hereby releases and indemnifies Carib Mall Bonaire from and against any and all claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with the stay or use of the property. The Guest is responsible for ensuring that all members of their party are informed of and comply with these Terms & Conditions.
1.2. Damage and Liability
The Guest is financially responsible for any damage caused to the property, interior, exterior, or facilities during the stay, whether caused by the Guest or any member of their party. The Guest agrees that any damage may be charged to the provided payment method.
1.3. Personal Belongings and Limitation of Liability
All personal belongings brought into the property remain the sole responsibility of the Guest. Carib Mall Bonaire is not liable for loss, theft, damage, or destruction of personal items, including items stored in safes (if available). The Guest acknowledges that personal insurance (including travel insurance) is the Guest’s own responsibility. Carib Mall Bonaire shall not be liable for any inconvenience, loss, or damage caused by utility interruptions, technical failures, maintenance issues, or force majeure events. Reasonable efforts will be made to restore services as soon as practicable.
1.4 Accommodation Rules and Use
* Check-in is from 15:00 hours, and check-out is no later than 10:00 hours unless otherwise agreed in writing.
* Early or late access on request only and cannot be guaranteed.
* The maximum number of guests must not exceed the number stated in the reservation. Exceeding the maximum occupancy may result in immediate termination of the stay and/or additional charges.
* The property is non-smoking unless explicitly stated otherwise.
* Pets, parties, events, loud music, or gatherings exceeding the reserved occupancy are not permitted unless expressly approved in writing.
* The Guest agrees to follow all instructions regarding use of the property and equipment, including any house manual provided.
* Carib Mall Bonaire reserves the right to enter the property for inspection, maintenance, cleaning, or emergency purposes. Where possible, reasonable notice will be given.
* Routine maintenance, including garden and pool maintenance, may take place during the stay and cannot be refused.
* In case of unforeseen circumstances, Carib Mall Bonaire may relocate the Guest to an alternative property of comparable standard. If this is not possible, unused nights will be refunded.
* Lost or damaged keys, remotes, or access devices will be charged to the Guest.
1.5 Complaints
Complaints must be reported as soon as reasonably possible. Late complaints may limit the ability to resolve issues or provide compensation. Self-repairs or external services without approval are not reimbursable.
1.6 Privacy and Data Protection (BES Compliance)
Carib Mall Bonaire processes personal data in accordance with applicable data protection principles under the laws of Caribisch Nederland (BES), aligned with internationally accepted privacy standards. Personal data is collected and processed for the purpose of: managing reservations and payments communication with Guests legal and administrative obligations operational management of properties.
Data may be shared only when necessary, with service providers, property owners, or payment processors. Appropriate technical and organizational measures are taken to protect personal data against unauthorized access, loss, or misuse. Data is retained only for as long as necessary for operational or legal purposes.
House Rules
2.1 guest compliance
Guests agree that the number of persons staying at the property must not exceed the number of guests confirmed in the reservation at any time during the rental period. All guests are required to comply with the terms and conditions of this agreement.
2.2 property condition
The property is provided in its current “as is” condition. Carib Mall Bonaire makes every effort to ensure that all facilities and amenities, including but not limited to internet access, television services, air conditioning, and swimming pools, are functioning properly. However, uninterrupted operation of these amenities cannot be guaranteed. In the event of any issues, we will make reasonable efforts to resolve them as quickly as possible after being notified.
2.3 Use of accommodation and liability
The accommodation may only be used for residential purposes and must be treated with care to prevent damage or loss. Neither Carib Mall Bonaire nor the property owner accepts liability for any injury, accident, or loss occurring during the stay or on the property, including common areas. Guests acknowledge that use of the accommodation and its facilities is entirely at their own responsibility and risk.
2.4 Personal belongings
All personal belongings brought into the accommodation remain the sole responsibility of the guest. Carib Mall Bonaire and the property owner are not responsible for any loss, theft, damage, or destruction of personal items during the stay.
2.5 Access to the property
Carib Mall Bonaire reserves the right to enter the property at reasonable times and with reasonable prior notice for inspection, maintenance or cleaning services, In case of emergency or when there is reasonable belief of immediate risk to persons or property, access may be granted without prior notice.
2.6 Unavailability of the property
If the accommodation becomes unavailable for reasons beyond the control of Carib Mall Bonaire, we will make reasonable efforts to arrange an alternative property of comparable standard in terms of capacity, location, and value. If no suitable alternative can be provided, all payments made will be refunded, and the reservation will be cancelled without further obligations for either party. Carib Mall Bonaire is not liable for failures or breaches by third-party suppliers.
